Terms and Conditions

  1. Scope
  2. These Terms and Conditions apply to all orders placed through the online shop www.zermattkaffee.ch. Differing terms of the customer apply only if expressly accepted in writing by Zermatt Kaffee.

2. Formation of contract

The presentation of products in the online shop is not a binding offer but a non-binding invitation to order. By submitting an order, the customer makes a binding offer to purchase. The contract is concluded once Zermatt Kaffee confirms the order by e-mail or ships the goods.

 

3. Prices

All prices are stated in Swiss francs (CHF). Statutory VAT is shown during the order process and added at checkout. Shipping costs are stated separately and displayed before the order is completed.

 

4. Payment

The payment methods offered during the order process apply (including TWINT, credit and debit cards, Apple Pay, Google Pay, Shop Pay, Klarna). Payment is due upon completion of the order unless otherwise agreed.

 

5. Delivery

Deliveries are made within Switzerland. Dispatch normally takes place on Tuesdays and Thursdays. Stated delivery times are guidelines. Delays for which Zermatt Kaffee is not responsible do not give rise to any claim for damages.

 

6. Retention of title

The delivered goods remain the property of Zermatt Kaffee until full payment has been received.

 

7. Inspection and notice of defects

The customer must inspect the goods immediately upon receipt. Obvious defects or transport damage must be reported in writing to info@zermattkaffee.ch within 7 days of receipt, quoting the order number. If timely notice is not given, the goods are deemed accepted.

 

8. Warranty

Zermatt Kaffee warrants that the goods are free of defects at the time risk passes. In the case of a justified and timely notice of defect, Zermatt Kaffee will, at its discretion, provide a free replacement or refund the purchase price of the defective goods. Coffee, tea and other foodstuffs are perishable products; the return of goods that are not defective is excluded (see Returns and Refund Policy).

 

9. Right of return

For online purchases, Swiss law grants no statutory right of withdrawal or return. The separate Returns and Refund Policy of Zermatt Kaffee applies.

 

10. Liability

Zermatt Kaffee is liable only for damage caused by intent or gross negligence. Liability for slight negligence and for the conduct of auxiliary persons is excluded to the extent permitted by law. Liability for personal injury is reserved in all cases.

 

11. Data protection

Zermatt Kaffee processes personal data in accordance with the Swiss Federal Act on Data Protection (revDSG). Details are set out in the privacy policy at www.zermattkaffee.ch.

 

12. Governing law and place of jurisdiction

Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Zermatt (Visp district, Canton of Valais), unless mandatory statutory places of jurisdiction for consumers apply.

 

13. Severability

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
